Right of Withdrawal – Reminder of French Law

The right of withdrawal allows the consumer to cancel an online order within 14 days, without having to justify their decision and without bearing any additional costs (except for possible return shipping costs).

Exceptions to the Right of Withdrawal – Reminder of French Law

Certain products or services are not subject to the right of withdrawal and therefore cannot be refunded.
This applies in particular to the following products:
- Personalized product:
The item has been made specifically for the consumer (for example, custom-made).
- Service fully performed before the end of the withdrawal period:
The performance of the service must have started with the consumer’s prior express agreement and their express waiver of the right of withdrawal.
- Product unsealed by the consumer after delivery, which cannot be returned for hygiene or health protection reasons.

Prior Agreement and Waiver of the Right of Withdrawal

When purchasing on this website, you ticked a box confirming that you had accepted these General Terms and Conditions of Sale prior to your purchase.

The DNA capsules we offer for sale are highly personalized, custom-made products. These products are not subject to the right of withdrawal (L221-28 3°).
The same applies to DNA collection kits which, for hygiene reasons, are also not subject to the right of withdrawal (L221-28 5°).

Therefore, under French law and for the reasons set out in the previous paragraph:
- Personalized product,
- Service fully performed within 14 days,
- Product unsealed by the consumer after delivery and which cannot be returned for hygiene reasons,
the exception to the right of withdrawal applies to the products and services sold on this website.

Our Order Cancellation Conditions

You may request to cancel your order under the following conditions:
- Within 12 hours of your order:
In this case, we will refund the price of your order less 2% of the total amount for banking transaction fees, but only if you paid by credit card on our website.
If you chose another payment method (bank transfer or bank cheque), we will refund the full amount of your order.
- Between 12 and 24 hours after your order:
We will refund the amount of your order less 10% of the total amount for administrative fees and as compensation for the DNA collection kit that may already have been sent to you.
Whether you paid by credit card, bank transfer, or bank cheque.
- Between 24 and 48 hours after your order:
We will refund the amount of your order less 50% of the total amount for administrative fees, as compensation for the DNA collection kit that may already have been sent to you, and for any fees that may already have been paid to the laboratory for DNA preservation processing.
Whether you paid by credit card, bank transfer, or bank cheque.
- If you have already returned your DNA collection kit:
We will not be able to refund your order and we will retain the full amount of your payment.

Non-Refund Conditions

If you have already returned your DNA collection kit, we will retain the full amount of your payment due to advance costs incurred with the laboratory and administrative fees.

DNA kits already shipped cannot under any circumstances be returned or refunded, even if they have not been opened.
Once they leave our logistics control, we cannot guarantee that they have not been exposed to environmental conditions likely to alter their integrity or proper functioning, such as exposure to excessive heat, humidity, dust, or any other inappropriate storage conditions.

Furthermore, by accepting these General Terms and Conditions of Sale of our website prior to purchase, you have lawfully waived your right of withdrawal and accepted our refund conditions as previously described on this page.

Regarding entrusted DNA samples

In accordance with current French regulations, DNA samples collected as part of our DNA storage services for individuals are never sequenced, analyzed, or transferred to third parties.
They are handled solely for long-term storage for the benefit of our clients.
Our company does not provide any in-house DNA storage service.
We do not retain any collected DNA.
No genetic analysis is performed and no genetic information is disclosed or shared, either with our company or with third parties.

Our partner laboratory, responsible for the physical storage of samples, is strictly required to comply with the same rules and legal obligations as our company.

After DNA storage, any remaining sample is destroyed, and neither our company nor our partner laboratory is authorized to retain any part of it.

Disputes and Amicable Settlement

Before initiating any legal proceedings, we invite you to contact us in order to seek an amicable settlement of any dispute.
Please feel free to contact us for any matter you consider contentious; an amicable settlement will always be possible and will be given priority whenever possible.
